1. About These Terms

These Terms of Service govern your use of the Pinbuds website and your purchase of any products from us. By browsing our store or placing an order, you agree to these terms in full. Please read them carefully before purchasing.

2. Acceptance of Terms

By accessing our website or completing a purchase, you confirm that you are at least 18 years of age, or that you have the consent of a parent or guardian, and that you have the legal capacity to enter into a binding agreement.

3. Our Products

We take reasonable care to ensure that all product descriptions, images, and pricing on our website are accurate. However, we do not warrant that descriptions are complete, current, or free from error. If a product you receive is materially different from its description, your rights under the Australian Consumer Law apply.

Colours and finishes displayed on screen may vary slightly from the physical product due to differences in monitor calibration and screen settings. This does not constitute a fault or misrepresentation.

Some products are listed as B-Grade or display items. The condition of these items, including any defects, cosmetic imperfections, or signs of use, is clearly disclosed in the product listing. By purchasing a B-Grade or display item, you acknowledge and accept its disclosed condition.

4. Pricing

All prices are listed in Australian dollars (AUD) unless otherwise stated. We reserve the right to change prices at any time. The price that applies to your order is the price displayed at the time you complete checkout.

For international orders, your bank or payment provider may charge currency conversion fees or foreign transaction fees. These charges are outside our control and are your responsibility.

We reserve the right to cancel an order if a pricing error has occurred on our website. If this happens, we will contact you promptly and provide a full refund of any payment made.

5. Payment

We accept the following payment methods:

- Credit and debit cards (Visa, Mastercard, and Amex where applicable)
- PayPal
- Afterpay and other buy now pay later services available at checkout
- Store credit and gift cards issued by Pinbuds

Payment is processed at the time of purchase. All transactions are processed through secure third-party payment providers. We do not store your full card details on our systems.

Buy now pay later services such as Afterpay are subject to their own terms and conditions. By selecting these options at checkout, you agree to be bound by the relevant provider's terms in addition to ours.

Store credits and gift cards are non-transferable, cannot be redeemed for cash, and are subject to any expiry terms stated at the time of issue.

6. Orders and Cancellations

Once your order is placed and payment is confirmed, we begin processing it promptly. If you need to cancel or amend your order, please contact us at hello@pinbuds.com as soon as possible. We cannot guarantee that changes can be made once an order has been processed or dispatched.

We reserve the right to cancel or refuse any order at our discretion, including where a product is out of stock, where a pricing error has occurred, or where we suspect fraudulent activity. If we cancel your order, you will receive a full refund.

7. Pre-Orders

From time to time we may offer products available for pre-order. When purchasing a pre-order item, you acknowledge the following:

- Estimated dispatch dates are provided in good faith but are not guaranteed
- Delays may occur due to manufacturing, shipping, or supply chain factors outside our control
- Your payment is taken at the time of purchase
- If a pre-order product is cancelled by us, you will receive a full refund
- Pre-order items may be shipped separately from in-stock items in the same order

We will communicate any significant changes to pre-order timelines via email.

8. Shipping and Delivery

We ship to Australia and internationally. Shipping costs and estimated delivery times are displayed at checkout. All delivery timeframes are estimates only and are not guaranteed.

We are not responsible for delays caused by third-party carriers including but not limited to Australia Post, international postal services, or courier providers. Once an order has been dispatched and a tracking number has been provided, responsibility for delivery passes to the carrier.

We are not liable for delays, losses, or damages caused by circumstances outside our control, including customs clearance, weather events, industrial action, or carrier error.

For international orders, you are responsible for any customs duties, import taxes, or fees charged by your country's customs authority. These charges are not included in our pricing and are not our responsibility.

If your order is returned to us due to an incorrect address provided at checkout, or due to failed delivery attempts, we will contact you to arrange reshipment. Additional shipping charges may apply.

9. Intellectual Property

All content on the Pinbuds website, including product images, illustrations, branding, copy, and design, is owned by or licensed to Pinbuds Pty Ltd and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or use any of our content without our written permission.

10. Third Party Services

Our website and operations may integrate with third-party platforms including but not limited to Shopify, BackerKit, PayPal, Afterpay, and Australia Post. We are not responsible for the performance, errors, or terms of these third-party services. Any issues arising from the use of third-party platforms should be directed to the relevant provider.

11. Limitation of Liability

To the maximum extent permitted by law, Pinbuds Pty Ltd will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of our website or products, including but not limited to loss of data, loss of revenue, or delays caused by third-party carriers or service providers.

Our total liability to you for any claim arising from a purchase will not exceed the amount you paid for the relevant order.

Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied by the Australian Consumer Law, to the extent that doing so would be unlawful.

12. Governing Law

These terms are governed by the laws of New South Wales, Australia. By using our website or purchasing from us, you agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

For customers located outside Australia, your local consumer protection laws may also apply where they cannot be excluded by contract.

13. Changes to These Terms

We may update these terms from time to time. The current version will always be published on our website with the date of last update. Continued use of our website or purchase of products after an update constitutes acceptance of the revised terms.
